Innovations of the anticorruption legislation

The Verkhovna Rada of Ukraine by the Law of Ukraine ‘’On amendments to some legislative acts of Ukraine regarding harmonization of Ukrainian legislation to provisions and standards of the Criminal convention on combating corruption’’ dated April, 18 2013 № 221-VII (hereinafter – the Law) has changed the Criminal code of Ukraine and the Law of Ukraine ‘’On basis of prevention and contraction the corruption’’.

The Law was approved with the purpose of partial implementation of the Criminal convention on combating corruption dated 01/27/1999 (hereinafter – the Convention), which was ratified by Ukraine on 10/18/2006.

Responsibility for proposing or giving the bribe (in minimal sizes) to a public person was substantially increased. This violating was transferred from administrative offenses to crimes.

Besides, the Law has increased the majority of penalties for corruption and bribery actions.

It should be noted that the legislature did not make radical innovations, as it did not prescribe the possibility of criminal responsibility for legal entities, which is prescribed in the Convention.
