Procedure of granting permission on rendering outsourcing services was approved

"The Procedure of granting permission on hiring employees for the further implementation of their work in Ukraine at another employer" has been approved by an Order of the Cabinet of Ministers №359 dated 20.05.2013 (the Procedure).

The Procedure specified that the outsourcing activities shall be indicated during the state registration as one of the main activities and shall be carried out only on the basis of the permit issued by the State Employment Service (SES).

To obtain the permit an application should be submitted to the SES with the following attachments:

- For the legal entities: a copy of the charter document, certified in the prescribed manner;

- For the individual entrepreneurs: the passport or a copy of the passport, in the case of an application through a representative;

- A project of the labor agreement, which contains provisions on the employee’s possibility to work for another employer and provisions on payment of wages to the employee;

- A copy of the document confirming the right of the authorized person to represent the interests of the applicant.

Decision to issue the permit (refuse in issuing) is being taken by the SES and is being formalized by an order within 10 working days from the date of registration of the application.

The Procedure also provides the form of the permit set out in the Annex to the Procedure.

The Procedure comes into force after the entry into force of the Law “On amendments to some Laws of Ukraine on issuing permit to hire employees for the further implementation of their work in Ukraine at another employer”.
