Opening a bank account after the state registration

In a letter of 25.12.2012 № 25-111/2807/12078, the National Bank of Ukraine (hereinafter – the NBU) has given an explanation related to changes in the procedure of opening customers` accounts caused by changes in the legal entities and individual entrepreneurs state registration procedure.

According to the law amendments the extract from the Unified State Register of legal entities and individual entrepreneurs is defined as the document identifying a legal entity, its separate units or an individual entrepreneur during commercial activity and bank account opening.

Due to this the NBU explained, that, in the event the state registration of a legal entity or an individual entrepreneur was held before December 17, 2012, identification of the customer and his bank account opening shall be provided on the former grounds and requirement for mandatory presentation of the extracts from the Unified State Register for such clients is not prescribed.

Meanwhile during identification and opening current or deposit bank accounts of a legal entity and an individual entrepreneur, whose state registration was held after December 17, 2012, presentation of the extract from the Unified State Register is required instead of presentation of copies of the documents confirming the registration with the bodies of the State tax Service and Pension Fund of Ukraine, and copies of the Unified State Register of Companies and Organizations of Ukraine certificates.

NBU concluded that from now on to open a bank account a notary certified copy of an extract from the Unified State Register, or the original extract from the Unified State Register, a copy of which shall be certified by the authorized officer of the bank, shall be filed.
