On October 2, 2012 by the Law of Ukraine "On amendments to some legislative acts of Ukraine concerning ensuring the functioning of retail deposit guarantee system" Article 26 of the Law of Ukraine "On the retail deposit guarantee system" was amended.

 Now the sum of the maximum amount of refund on retail deposits is fixed and can not be less than 200 000 UAH. Reducing this amount by a decision of the Retail Deposit Guarantee Fund is not allowed (hereinafter - the Fund).

 It should be recalled that the Law of Ukraine "On the RetailDeposit Guarantee Fund " on September 20, 2001 N 2740-III, which guaranteed payment of 150 000 UAH was repealed due to adoption of the Law of Ukraine "On the retail deposit guarantee system " from February 23, 2012 (hereinafter - the Law № 4452-VI). The Law № 4452-VI was significantly aggravating the situation of depositors of banks as it did not contain the size of the guaranteed amount of compensation to the depositors under their deposits and did not indicate the legal grounds for banning the adoption by the administrative council of the Fund, of decisions decreasing the mentioned amount .

Is to say that for the deposits made before the entry into force of the Law № 4452-VI, a fixed amount of 150 000 UAH remained in force (due to the impossibility of retroactive force of the law, that impairs the position of a person).

  New amount of the guaranteed payments affects all deposits, regardless of when they were made.
